1. AGREEMENT TO TERMS

By accessing or using racedayz.co ("the Site"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Site.

2. USE OF THE SITE

Prices are listed in Australian Dollars (AUD) and include GST where applicable. We make every effort to display accurate pricing and product information, but errors may occur. If we discover an error in pricing, we will contact you and give you the option to proceed at the correct price or cancel your order.

4. ORDERS AND PAYMENT

By placing an order, you warrant that:

  • You are legally capable of entering into binding contracts
  • All information you provide is accurate and complete
  • You are authorized to use the payment method provided

We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

5. AUSTRALIAN CONSUMER LAW

Nothing in these Terms limits or excludes any guarantees, warranties, representations, or conditions which cannot be excluded under the Australian Consumer Law (ACL) or any other applicable law.

Under the ACL, you have certain rights including:

  • Products must be of acceptable quality
  • Products must match their description
  • Products must be fit for any disclosed purpose

For major failures with products, you are entitled to a replacement or refund. For minor failures, we are entitled to a reasonable opportunity to repair or replace the product.

6. INTELLECTUAL PROPERTY

All content on this Site, including text, graphics, logos, images, and software, is the property of RaceDayz or its licensors and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

7. PRODUCT USE AND SAFETY

Our racing eyewear products are designed for motorsport and high-performance activities. You acknowledge that:

  • You are responsible for ensuring products are suitable for your intended use
  • You should follow all care and usage instructions provided
  • Prescription or custom lens products are made to your specifications and may not be returnable

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, RaceDayz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased through it.

Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the product or service in question.

9. INDEMNIFICATION

You agree to indemnify and hold harmless RaceDayz, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of the Site.

11. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of New South Wales.
